This decision was primarily taken due to the protests made against the lenders in Atlanta resulting from the sharp rise in the number of foreclosures in the city and the metro as well.</p>
<p>According to the current foreclosure records on a nationwide basis, Georgia has ranked as one of the top states that are hit by the <strong><a href="http://www.foreclosurewarehouse.com/">foreclosure</a> </strong>within the third quarter of July to September. At least one out of every 119 houses faced foreclosures. Georgia ranked seventh in this foreclosure record and there were 33,000 filings for foreclosures. This also included 11,243 REO units with at least trustee sale notices numbering to 22,000.</p>
<p>As compared to the last quarter and 2008 third quarter, Georgia’s rate of foreclosure is quite higher in 2009. Since, April to June there had been a 7% hike as compared to 2008s third quarter featuring almost 25%. Bank failures have also affected Georgia. Other than, being affected by foreclosures, there were, at least 20 banks in Georgia that were closed. The property market was loaded by the banks including the properties owned by the banks not only in the commercial sector but also in the residential sector.</p>
<p>To improve the attempts for helping those homeowners who are troubled, the Wells Fargo with its Wachovia section also attempted to give loans to those borrowers who were finding it tough to repay their loans on a monthly basis. Free workshops were also held by two banks through their representatives including the specialists who tend to help the borrowers to select the right solutions to protect their homes and properties from the pangs of foreclosures.</p>
<p>The homeowners, who want to negotiate, the Wells Fargo website is always at your service. The ones who are not involved with Wells Fargo, even they can go to the U.S. Housing and Urban Development Department website for assistance.</p>
<p>The other solutions provided by the Wells Fargo website are the likes of Fast-Track Solution, Project Lifeline, and Hope Now Alliance. The Project Lifeline program gives special focus to the homeowners who have not paid their mortgages for at least 3 months and Fast-Track Solution tends to focus on those borrowers who have got adjustable rate mortgage including the subprime loans.</p>

<p>A fall in the number of home <strong><a href="http://www.foreclosurewarehouse.com/">foreclosures</a> </strong>might signify a stable market and in Howard County the foreclosures have decreased following the spiking of the sheriff’s sales in summer. For the local property experts this was a good news as on that day the congress announced the extension of the tax credit for the buyers indulging in home buying for the first time. According to the report of the Howard County Sheriff Department at least 44 foreclosures took place in November, and in December this figure is expected to be 41 according to Sheriff Marty Talbert.</p>
<p>Since the reporting of 83 foreclosures for July by the sheriff’s department, the number of foreclosures have reduced by almost 50%. Talbert commented that, “It has slowed down a little bit. And I’m not sure what the real answer here is, whether we reached a holiday time period. It’s pretty hard to throw somebody out of a house right around Christmas.” On a monthly basis the <strong><a href="http://www.foreclosurewarehouse.com/mortgage.php">mortgage</a></strong> foreclosures decreased this year in comparison to the last two years.</p>
<p>The banks according to the Clerk’s Office in Howard County, have filed with the courts for at least 662 foreclosures in this year. This gives an average of 55.2 on a monthly basis. In 2008, on an average the banks foreclosed at least 69.2 properties every month and in 2007 this figure was 71.8.</p>
<p>According to the assumptions of few local property experts, the fall in foreclosures may sound like a good news, especially to the home sellers including the <strong><a href="http://www.foreclosurewarehouse.com/real_estate.php">real estate</a></strong> firms. The executive vice president for the Realtors Association of Central Indiana, Kathy Harbaugh feels that this decrease in the number of foreclosures is indeed a sign of stability in the property market.  She further emphasized that, “I think that probably the decline in foreclosures is that we’ve gotten, finally, past that period of high foreclosure. It is starting to stabilize the housing market to something we’re more used to.”</p>
<p>Jeannie Kuhn, being a sales associate for Re/Max Real Estate One in Kokomo, observed that the chances are that the property values will increase following the numerous foreclosures led to a decrease in most of the areas. Kuhn observed, “For one, there’s the mind set that this should be the price‚ [for all homes] when people are buying at a foreclosure price. If we can swing this in another direction, we’ll be in better shape.”</p>
<p>The conditions of the local housing market improved after the Congress enactment of the tax credit for the ‘first-time home buyers’. This tax credit was worth $8,000.</p>
<p>According to Harbaugh and Kuhn the property market may experience another jerk thanks to the Congress enactment of extension regarding the tax credit. Harbaugh observed that, “When you have an active market, everybody wins. With the sellers, more buyers in the market could result in a better pricing in the homes. It’s too early to tell. We don’t know how many [the tax credit] will draw in.”</p>

<p>The third quarter of this year featured a 23% higher rate of <strong><a href="http://www.foreclosurewarehouse.com/foreclosure.php">foreclosure</a></strong> according to a current report while at the same time last year, the number of <strong><a href="http://www.foreclosurewarehouse.com/">foreclosures</a></strong> peaked at record levels. In fact, last year during the second quarter the numbers were even higher locally. The RealyTrac report featured that foreclosure filings including default notices, bank repossessions and scheduled auctions were with 937,840 properties nationwide during the third quarter.</p>
<p>This was a 5% increment since the last quarter and from the last year’s third quarter, this was almost a 23% hike. This indicates that at least one out of every 136 houses in the U.S., got filings for foreclosures within this quarter. This is reported to be the highest among the quarterly foreclosures since 2005s first quarter.</p>
<p>In <strong><a href="http://www.foreclosurewarehouse.com/homes/UT/SALT LAKE/">Lake County</a></strong> within the same time span there were at least one out of every 53 houses that faced a foreclosure notice. This led it to the position of No. 19 in terms of foreclosures among the 58 counties. During the third quarter of this year there were at least 666 properties in the Lake County that went through the process of foreclosure filings.</p>
<p>This was a 20% fall in the foreclosure filings during the second quarter, which had 835 foreclosure filings according to RealtyTrac. The report, the results of third quarter in Lake County seemed to be better than the results of the second quarter. There was a 41% increase compared to last year’s third quarter, which had 470 <strong><a href="http://www.foreclosurewarehouse.com/foreclosure_filings.php">foreclosure filings</a></strong>.</p>
<p>Nationwide filings, according to RealtyTrac were 343,638 properties within September. There was a 4% fall since last month’s record and from last year’s September there was a 29% increment. The number of foreclosure filings for the month of September that still constituted the third highest total on a monthly basis.</p>
<p>The highest foreclosures occurred in <strong><a href="http://www.foreclosurewarehouse.com/homes/NV/">Nevada</a></strong> during the third quarter. In Nevada, within 47,925 properties at least 23 houses received filings for foreclosures. Approximately 250,054 properties were filed in California for foreclosures. This made California accountable for at least 27% of the total foreclosures.</p>
<p>According to the report, the foreclosures in California went through a drastic fall by almost 2% from the last quarter as there was a 10% fall in the number of default notices. The foreclosures that are scheduled hiked by 4% from the last quarter and the number of bank repossessed properties rose by 12%.</p>

To avoid being homeless, more homeowners are presently asking for help about <strong><a href="http://www.foreclosurewarehouse.com/foreclosure.php">foreclosures</a></strong>. At a Foreclosure Intervention Workshop, people were seeking help to deal with foreclosures. This workshop was organized by Community Hope Center located in the Cottage Hills. Lindy Tarrant, is a counselor working with Beyond Housing, which is a nonprofit agency. She convinced the participants to be positive and to keep on trying. According to Tarrant, &#8220;Know the facts and know what to do. Don&#8217;t try to dig out on your own when there are resources out there that can help you.&#8221;</p>
<p>Talking to the Loss Mitigation Department of the lender is very important. Tarrant observed that, &#8220;One of the biggest mistakes people make is that they agree with the person in collections because they&#8217;re afraid. They often try to scare you that something will happen eminently if you don&#8217;t make a promise to pay, but this is not how foreclosure and eviction happens &#8211; even though they might try to make you believe it does.&#8221; She also emphasized that the Loss Mitigation Department can give options to the mortgage holders. However, the collections department is not entitled to do this. Completion of foreclosures primarily takes one year to 15 months in Illinois starting from the date when the payment is missed for the first time.</p>
<p>The lawful process of foreclosure is actually the judicial auctioning of a house to reclaim the debt that is payable to the lender by the borrower. Till date 1,049 foreclosure cases had been filed in the Madison County. Tarrant further feels that, &#8220;Just because you have received a notice of default and you don&#8217;t have the money in full, it doesn&#8217;t necessarily mean that you will lose your home. But you must be realistic about what you can pay. Do not commit to an unrealistic budget because you must stick to whatever agreement you make with your lender.&#8221;</p>
<p>Tarrant gave out certain steps for following retention options:</p>
<p>•	Plan for Repayment – This involves increment of the monthly payments until the borrower can reach the limit of the current loan.</p>
<p>•	Forbearance – This is an official and written agreement that ensures the reduction or suspension of the repayments that have to be made for a particular time. After this you can resume the payments of the mortgages and can have some extra to help you catch up.</p>
<p>•	Loan modification – This is a permanent modification made in the terms and negotiations of the loans between the lenders and the borrowers.</p>
<p>•	HOPE for Homeowners – This is the Making Home Affordable Program by President Obama.</p>
<p>•	Refinancing – It is an option that is made available to those borrowers and homeowners who usually pay their mortgages right on time and are not sufferers of have not suffered any professional hazards.</p>

<p>The Hope Now report shows that Florida’s records as compared to the  first quarter’s 23,463 have increased. In the months of July and  August, there were, another 31,683 that were finalized. This transcends  this rate to approximately 47,000 for the whole quarter. However, there  is a slow down in the modifications involving reductions in interest or  principal or even an extension in the longevity of the <strong><a href="http://www.foreclosurewarehouse.com/blog/category/loan/">loan</a></strong>. In the  second quarter, there were 23,285 such modifications. Compared to the  first quarter’s 28,670 the fresh figures were quite less.</p>
<p>In the months of July and August, there were merely 9,118 mortgages,  that went through modification. Going by that rate within the full  quarter, very less than 14,000 will go for modification. An increasing  number of short sales are not the prime reason for the fall in the  number of <strong><a href="http://www.foreclosurewarehouse.com/foreclosure_filings.php">foreclosure filings</a></strong>. The third  quarter saw the state going through at least 19,000 foreclosures and in  the second quarter, there were around 18,000 foreclosures. In Olefson’s  words, &#8220;We are going to see more foreclosures. There is no doubt about  it.&#8221; However, for most of the homeowners who have to face foreclosures,  it might not mean displacement on an immediate basis. They may not have  to leave as soon as the process of foreclosure is over.</p>
<p>According to a ‘Deed for Lease’ program by Fannie Mae, the  struggling homeowners will now be able to pay their rent and at the  same time stay in their houses for approximately a year’s time and so  they do not have to surrender their properties to the lenders on  defaulting with repayments. Jay Ryan, the Vice President of Fannie Mae  observed that, &#8220;This new program helps eliminate some of the  uncertainty of foreclosure, keeps families and tenants in their homes  during a transitional period, and helps to stabilize neighborhoods and  communities.&#8221;</p>

However, RealtyTrac Inc., analyzed that their rate of notices for local default including repossessions accounted for only one-half of the national figures during the 3rd quarter of this year. At least, one out of every 235 properties in Chattanooga metro went through <strong><a href="http://www.foreclosurewarehouse.com/foreclosure.php">foreclosure</a></strong> since July till September according to the estimation of the RealtyTrac.</p>
<p>There were at least one among every 119 homes in Georgia that faced loan defaults or repossessions from the banks within the July-September duration. The Peach State stood 7th in the ranking for the number of homes being foreclosed. This year’s foreclosures in the Chattanooga were 12% more than last year’s figure and it numbered to 971 foreclosures. However, the rate of <strong><a href="http://www.foreclosurewarehouse.com/homes/TN/HAMILTON/CHATTANOOGA/">foreclosures in Chattanooga</a></strong> remained less than half compared to the other metros in the RealtyTrac list. Among the top 10 scorers like <strong><a href="http://www.foreclosurewarehouse.com/homes/CA/">California</a></strong>, <strong><a href="http://www.foreclosurewarehouse.com/homes/NV/">Nevada</a></strong> and <strong><a href="http://www.foreclosurewarehouse.com/homes/FL/">Florida</a></strong> in terms of foreclosures Chattanooga was no where with a minimal 1/5th foreclosure rate.</p>
<p>According to Nickie Schwartzkopf who is a broker a Realtor and also the president of Chattanooga Association of Realtors, “We never had that big upswing in prices that many other areas did in the past, and that turned out to be a blessing for us in Chattanooga. Home buyers here didn’t get as many of the loans that were questionable.”</p>
<p>With the rising rate of unemployed people in the metro of Chattanooga the foreclosures figure will rise according to Schwartzkopf. She further stressed that, “We have not bottomed out yet. Over the past year, some of the lenders held back on some of the foreclosures and allowed people to try to restructure their loans. But now it’s coming to the point for a lot of people that it is going to involve more foreclosures.” approximately 400 homes will be foreclosed. According to Ms. McLean, a mortgage lender, “We’re still in an unprecedented time, but I hope we’ve hit — or soon will hit — the bottom.”</p>
<p>According to Randy Durham, who is a broker for Keller Williams Realty and president-elect of the Chattanooga Association of Realtors, “as high as I’ve ever seen it. That does tend to hurt the average home seller because of the competition with these <strong><a href="http://www.foreclosurewarehouse.com/">foreclosed homes</a></strong> on the market.” In the previous month there were at least 7% of the homes among the Realtors’ Multiple Listing Service, that faced foreclosures and at least 1.7% faced short sales and the some homes were sold below their original price just to avoid foreclosures.</p>
<p>Chief Executive of RealtyTrac James Saccacio commented that, “While toxic subprime mortgages drove much of that first wave of foreclosures, high unemployment and exotic Alt-A Option Adjustable Rate Mortgages are spreading the foreclosure flood to more metro areas in 2009.”</p>

<p>The number of households caught up in the <strong><a href="http://www.foreclosurewarehouse.com/">foreclosure</a></strong> crisis rose more  than 5 percent from summer to fall as a federal effort to assist  struggling borrowers was overwhelmed by a flood of defaults among  people who lost their jobs.</p>
<p>The foreclosure crisis affected nearly 938,000 properties in the  July-September quarter, compared with about 890,000 in the prior three  months, according to a report released Thursday by</p>
<p>RealtyTrac Inc. That  puts foreclosure-related filings on a pace to hit about 3.5 million  this year, up from more than 2.3 million last year.</p>
<p>Unemployment is the main reason homeowners are falling into trouble.  While the economy is likely out of recession, the unemployment rate —  now at a 26-year high of 9.8 percent — isn&#8217;t expected to peak until the  middle of next year.</p>
<p><strong><a href="http://www.foreclosurewarehouse.com/mortgage.php">Mortgage</a></strong> companies sometimes allow unemployed homeowners to defer three  to six months of payments while they are looking for a job. But there&#8217;s  little else they can do.</p>
<p>&#8220;The sheer scale of the problem is preventing the <strong><a href="http://www.foreclosurewarehouse.com/home_loans.php">loan</a></strong> modification  programs from having the kind of impact we&#8217;d all like&#8221; said Rick  Sharga, RealtyTrac&#8217;s senior vice president for marketing.</p>
<p>Last week, the Obama administration hailed a milestone in its mortgage  relief effort, reporting that 500,000 homeowners have received help  since the program was launched in March. But new defaults are still  exceed the number of borrowers getting help.</p>
<p>Mortgage companies have slowed down the pace of <strong><a href="http://www.foreclosurewarehouse.com/blog/loan/racing-against-odds-evade-foreclosures/">foreclosures</a></strong> as they  evaluate whether borrowers qualify for the administration&#8217;s program.  Analysts, however, forecast that many of those homeowners won&#8217;t  qualify, and foresee a new wave of <strong>foreclosed properties</strong> hitting the  market next year. That&#8217;s likely to further depress home prices.</p>
<p>Some homeowners are in such a massive financial hole that it&#8217;s hard to  design a modification that will actually provide lower payments. And  some have avoided paying their monthly bill for a long time.</p>

<p>By the second quarter of this year, the number of <strong><a href="http://www.foreclosurewarehouse.com/">foreclosed homes</a></strong> increased to approximately 17% despite the implementation of the federal program to help the borrowers to protect their homes from foreclosure. The figure of <strong><a href="http://www.foreclosurewarehouse.com/homes/">foreclosures</a></strong> rose to 711 in the Monterey County during the second quarter of this year. While during the first quarter of this year, the records featured 680 foreclosures in this county. This is almost 4.6% hike according to Marina J. Camacho, who is the administrative services coordinator of the county.</p>
<p>Though the local figures are quite high, overall there have been fewer foreclosures this year compared to the same time in the previous year. During the second quarter of 2008, there were 754 <strong><a href="http://www.foreclosurewarehouse.com/homes/CA/MONTEREY/">foreclosures in Monterey</a></strong> County. This indicates more foreclosures in 2008 compared to 2009.</p>
<p>The national figures feature for foreclosures shows 106,007 within the second quarter as compared to the figure of 90,696 within the previous 3 months as per the reports of the Office of Thrift Supervision. According to the quarterly report, the mortgage figure has reached to 64%, which is an exceptional hike. This hike is consequent to the moratoriums imposed on the government foreclosures.</p>
<p>During this period attempts to help borrowers retain their homes also rose through the programs like Making Home Affordable. According to this plan the lenders received some payments in order to reduce the debts of the homeowners. As per the government data since the initiation of this program there were at least 400,000 borrowers who received help. The intention of the Obama government is to help at least 500,000 borrowers within November.</p>
<p>Moreover, the increasing trend of joblessness not only hindered the efforts to control foreclosures but also stepped up the occurrences of foreclosures. In the meantime, the figure of failure borrowers increased grossly and most of them had missed out on approximately two payments. This led to increment of foreclosures by at least 10%. According to the mortgage data, &#8220;continued to reflect negative trends influenced by weakness in economic conditions including high unemployment and declining home prices in weak housing markets.&#8221;</p>
<p>The report also reflected the threat posed by the numerous loans that are risky and one of the options being adjustable-rate mortgages. In most cases though, the borrowers take loans as per the low interest rates but in the process the payments increased gradually, inflicting the risk of home loses on the borrowers. Above 15% of such loans led to delinquencies during the second quarter of this year. The report also stated that, &#8220;The risks of these loans and geographic concentration caused them to perform significantly worse than the overall portfolio.&#8221;</p>

<p>As these programs are being known by homeowners all around the country, the number of these that adhere to such assistance programs in the quest to keep their homes and maintain their responsibilities fulfilled, such as the payment of the mortgage loans is growing strongly. This also creates a retribution on the price of the properties, meaning that the lending institutions do not have to seek to recover all the investments that they have made on one single collection.</p>

Majority of the loans would just melt away into foreclosures and as people sell out homes or change mortgage terms these loans would cease to exist altogether as pointed by  Sam Khater, a senior economist.</p>
<p>Technically speaking, adjustable loans have lower interest  rates than fixed rate mortgages which incidentally became popular about  3 decades ago in the 1980’s when interest rates were exorbitantly  high and very few people  could afford the  floating rates, they are now  gaining popularity once again because of aggressive marketing by <strong><a href="http://www.foreclosurewarehouse.com/blog/foreclosure-filings/lenders-end-up-repossessing-homes-in-foreclosure-processings/">lenders</a></strong>. These loans allured and brought in a lot of borrowers but also seduced people those who could not pay back which eventually led to the sub prime crisis and then of course to a whole global economic downturn.</p>

<p>The <strong><a href="http://www.foreclosurewarehouse.com/homes/CA/SAN DIEGO/">San Diego</a></strong> County experienced a slight fall in the <strong><a href="http://www.foreclosurewarehouse.com/">foreclosures</a></strong> in the previous month, however, the number of defaulters are increasing  and the lenders are still; struggling to help those homeowners who are  unable to repay their debts. According to the MDA DataQuick report,  last month itself there were at least 1,101 foreclosures.</p>
<p>This figure is 8% less than 2008 August and 49% less than September  2008 figure. The default notices being the first stage of foreclosure  amounted to 2,726, which is 3% up since August but this figure is  almost double the figure last year as default actions were delayed to  some extent by the new regulations. According to the analysts this  indicates that the trend of trouble and distress will continue.</p>
<p>John Walsh, the President of DataQuick observed that, “There&#8217;s a  batch of truly nasty loans that were made in mid-2006. There&#8217;s another  batch made in late 2006. These are worse than the month before and  after, and it&#8217;s taking a long time to process them.”</p>
<p>According to Andrew LePage, an analyst in DataQuick, the focus of  trouble is shifting from low-cost, subprime loans to higher-cost in the  inland locations and among the coastal properties, the trend has  persisted at prime loans.</p>
<p>For instance, in at least 6 of the ZIP code areas featuring high  prices featured an increment of 36% to 140% among the notices of  default as compared to the average figure in the last year. However,  the number of defaults continued to remain unusual as they were 8 in  Coronado, 12 in Del Mar, 21 in Hillcrest, 26 in Mission and Pacific  Beach, 34 in Carmel Valley, and 39 in Encinitas.</p>
<p>According to the report of the Mortgage Bankers Association for  August the defaults with mortgages were crossing all limits since 1972.  The rate of defaults on a seasonal basis was at 9.2% by the end of the  second quarter and compared to the last year’s figures this was almost  up by 2.8%. Dustin Hobbs, the representative of the California Mortgage  Bankers Association, observed that the lenders are not in a major rush  to work on the process of <strong><a href="http://www.foreclosurewarehouse.com/foreclosure.php">foreclosure</a></strong> if they feel that with the  present amount of incentives the loan modification can be encouraged.</p>
<p>However, Paul Leonard from the Center for Responsible Lending  commented that the consumers have continued to complain regarding the  lenders including the companies for loan servicing as they tend to take  a lot of time for making decisions. They add to the problems of the  consumers when they lose the paperwork and the consumers are shunned  from agent to agent but they do not get any help.</p>
<p>Leonard stressed that, “The capacity of the servicers, both human  and technological, is still limited and not sufficient to keep pace  with the scope of the problems they&#8217;re dealing with.” The president of  CMG Mortgage Chris George in San Ramon also being the secretary of the  mortgage bankers group disagreed to the view.</p>

Although economy experts and financial professionals have gone on to say that the economy is looking upwards, there are still cases of homes being lost and jobs no more being safe. Although &#8220;J.P Morgan&#8221;, the behemoth of the banking industry has earned approximately $3.6 billion in just one quarter in the last year still reports are there of unemployment being up at 10%. The stock markets too look bullish as “Dow Jones” index hit ten thousand in 2009 for the first time. The question is, if things are so hunky dory then why are <a href="http://www.foreclosurewarehouse.com/"><strong>foreclosure</strong></a> levels at an all time high across the length and breadth of the country, especially in <strong><a href="http://www.foreclosurewarehouse.com/homes/MO/">Missouri</a></strong> and <strong><a href="http://www.foreclosurewarehouse.com/homes/KS/">Kansas</a></strong>?</p>
<p>Reports by &#8220;Kansas City Business Journal&#8221; states that foreclosure cases in Missouri rose by 8.8% as compared to last year in the month of September. Another report by “RealtyTrac Inc” from California says that foreclosure filings have shot up by 22.4% in the state of Kansas. This is being witnessed throughout the country. Even though foreclosure cases dropped by 4% in September as compared to August as according to reports from 343,638 homes, it only revealed a 29% upward trend from last year September.</p>
<p>According to various financial experts, the reason that this is happening is that the banking firms have changed the lending procedure. When the banks had been given financial aid in 2008 by the Government, that is when they moved away from lending money in the earlier fashion that they were used to. Earlier the banks had always profited by giving credit to medium scale enterprises which had led to the job boom. About 64% jobs were developed in the last fifteen years. Now banks are earning by the taxes that people pay, and are investing that sum into other commercial schemes. In the process, small firms are feeling the heat and leading to job losses. According to Peter Kyle, who is a professor of finance in Maryland University- if the economy revives, then all business sectors would be requiring further credit, but medium and small industries are still trying to turn around and this might take a while. He also feels that as things improve small industries are going to protest about credit policies.</p>
<p>It is no use blaming the banks as they had been hit the hardest by the recession, so naturally they would be a tad cautious about giving credit.</p>
<p>David Kotok says that the banking sector has not recovered as it should have, and that the small sectors have an advantage which is, cheap borrowing and low interest rates.</p>

During the 3rd quarter of this year the number of <strong><a href="http://www.foreclosurewarehouse.com/foreclosure_filings.php">foreclosure filings</a></strong> were 937,840. This figure shows an increase by almost 23% since the same time period last year as reported by RealtyTrac.</p>
<p>Compared to the second quarter there was a 5% hike at few stages of foreclosures. During this quarter there were at least one out of 136 houses which had to face the process of foreclosure filings and the according to the RealtyTrac reports this quarters figures are the highest in terms of quarterly figures. Rick Sharga in RealtyTrac observed that, &quot;We&#8217;d hoped this year would be the peak as far as foreclosures, but we&#8217;ve since concluded it will not be. We should see a peak in foreclosures at the end of 2010.&quot; There are numerous aspects, which have propelled the situation of foreclosures to this extent. Numerous lenders while dealing with the felonious borrowers avoid the issue of foreclosure. At the end of the moratoriums, the foreclosure woes, will be faced by those borrowers who unfortunately, do not qualify for loan modifications.</p>
<p>A majority number of <strong><a href="http://www.foreclosurewarehouse.com/home_loans.php">loans</a></strong> with adjustable-rates are scheduled for resetting and this means that the monthly payments will rise for most homeowners. More borrowers ended up losing their homes as the payments were increased and the rate of unemployment, which was initially 9.8% is supposed to go up to 10% and above. <p>The senior economist at First American CoreLogic, Sam Khater  observed that, most of the loans would disappear into the folds of  foreclosure before adjustment. While other reasons like refinancing and  mortgages modifications will result to fading away of the loans. Khater  observed, &#8220;I suspect that at least a third of these [adjustable loans]  won&#8217;t be around by the time they are scheduled to reset.&#8221; Prime  borrowers with conventional adjustable loans usually have lower rates,  but in the 1980s with rising interest rates the borrowers could not  afford to take even fixed-rate mortgages. They made news again when  they were marketed by the lenders through unnatural low rates due to  rising housing costs.</p>
<p>These loans attracted numerous of subprime borrowers during the  current boom. In fact, the ones with a poor credit condition are more  attracted to these loans. However, with falling home prices the  subprime market worn out as the loans were adjusted. The rates of  interest for the subprime borrowers rose and their monthly payments  increased. With falling prices, their houses had to be sold or  refinanced.</p>
<p>The sub prime loans were wiped out by the foreclosures. The  adjustable loan rates might also be reduced as the rates are too low  according to Guy Cecala, the publisher with Inside Mortgage Finance.  Cecala observed that, &#8220;We have a long way to go before prime borrowers  see a big jump in payments. It&#8217;s not something people are predicting  for 2010. We&#8217;re looking at 2011 and 2012. None of us know what&#8217;s going  to happen then, but we&#8217;re assuming rates will rise.&#8221;</p>
<p>According to Greg McBride, a senior financial analyst at  Bankrate.com, &#8220;We&#8217;ve seen this movie before. We know that interest  rates are going to go up, and go up a lot, at some point in the next  several years. You don&#8217;t want to be holding an adjustable-rate mortgage  when that happens.&#8221; The borrowers with ARMs option are the most  susceptible ones in the regions of <strong><a href="http://www.foreclosurewarehouse.com/homes/CA/">California</a></strong> where home prices rose.</p>
<p>The option ARMs also known as pick-a-pay mortgages lets the borrowers select the amount of monthly payment they wanted to make.</p>

<p>In the Erie County, the falling number of mortgage <strong><a href="http://www.foreclosurewarehouse.com/">foreclosures</a></strong> in July and August features a constant lowering of trends in foreclosures of homes. The reports of the clerk&#8217;s office in Erie County state that within the first eight months, foreclosures remained low at 35% resulting to 930. The initial fillings for foreclosures remained as low as 15% since 2008.</p>
<p>According to Kathleen C. Hochul, the clerk in the Erie County, the 3rd quarter of this year is supposed to feature the lowest foreclosure rate since 2004. The number of foreclosures in July and August figured to 159 and in September it is expected to feature 138. Lastly, the figures of July and August featuring 79 and 80 respectively are recognized as the lowest among the foreclosure figures.</p>
<p>Hochul feels that, &#8220;Not only did Erie County weather this particular cloud during the national economic storm, the local forecast continues to improve for existing homeowners.&#8221; The Western New York Law Center report states that at least 424 housing properties had filings for foreclosures against them within the 3rd quarter of this year. Compared to the last year’s records this year’s 2nd quarter records show a fall by 26.8%. The figure for commercial foreclosures was a bit more confusing with 21 homes being affected within the 3rd quarter of this year.</p>
<p>According to Kathleen Lynch, the senior attorney at the law center, this stemming of foreclosures was possible due to the attempts by the federal government including the mortgage industries and banking industries. Though, this opinion is totally at loggerheads with the housing counselors, consumer advocates’ criticisms who feel that enough was not done by the government to stem the foreclosures.</p>
<p>Lynch observed that, &#8220;Our experience has been that, though it was a little slow in getting going, we saw more participation by servicers and review of loans over the summer months. We are getting loan modifications. All in all, I think the drop is a positive reflection on the efforts.&#8221;</p>
<p>Lynch commented that at least 90% of the homeowners tend to ask for help even before they get the filings for foreclosures. she said, &#8220;This is good, and seems to indicate that homeowners are seeking help early in the process.&#8221;</p>
<p>However, all over the country the situations were not favorable. The RealtyTrac&#8217;s monthly report suggested that, there were 358,471 properties facing filings and default notices leading to <strong><a href="http://www.foreclosurewarehouse.com/blog/category/auctions/">auctions</a></strong>.</p>
<p>James J. Saccacio, the RealtyTrac CEO observed that, &#8220;There is still an ample supply of properties filling the foreclosure pipeline even while the outflow of bank-owned <strong><a href="http://www.foreclosurewarehouse.com/reo_properties.php">REO properties</a></strong> onto the resale market is being more carefully regulated. We also saw a record high number of properties either entering default or being scheduled for a public foreclosure auction for the first time.&#8221;</p>
<p>Nevada suffered the most as 1 out of every 62 houses faced foreclosures. <strong><a href="http://www.foreclosurewarehouse.com/homes/FL/">Florida</a></strong> ranked 2nd as 1 out of every 140 homes went through foreclosures. <strong><a href="http://www.foreclosurewarehouse.com/homes/CA/">California</a></strong>, with 1 out of every 144 homes was badly affected. Topping the list were the states of Arizona, Michigan, Georgia, Idaho, Utah, Colorado, and Illinois. <strong><a href="http://www.foreclosurewarehouse.com/homes/NV/CLARK/LAS VEGAS/">Las Vegas</a></strong> led the list of states of <strong><a href="http://www.foreclosurewarehouse.com/homes/NV/">Nevada</a></strong>, California and Florida. In <strong><a href="http://www.foreclosurewarehouse.com/homes/NY/">New York</a></strong> there were 5,350 filings in the month of August.</p>

<p>The National Association of Realtors observed that sales of homes all over the western zone featured a major increase of approx 4% in the month of July as more purchasers tore up the <strong><a href="http://www.foreclosurewarehouse.com/foreclosure.php">foreclosure</a></strong> scenario and mainly the buyers buying homes for the first time also intended to take utmost advantage as this indicated a tax credit on a temporary basis.</p>
<p>This mainly resulted to the pulling down of the average prices of the homes in West by approx 28% that is almost $202,300. Patrick Newport, who is an economist working with IHS Global Insight, regarding the declining sales commented that, &#8220;In the West, it&#8217;s still the economy that&#8217;s determining sales.&#8221;</p>

<p>Hanvey just owning a great house for $243,000 observed that, &#8220;I feel like I definitely bought at the right time. I&#8217;m hoping to stay in this home for the rest of my life, as long as we don&#8217;t lose our jobs or anything like that.&#8221;</p>
