Foreclosure Reversed On Home At Centereach
January 17th, 2008
A fresh loan in the New Year may help Janet Beck retrieve her home, foreclosed and auctioned three months ago. The West Islip attorney Alfred Jackson who procured her home at Alden Lane, Centereach, went back on his deal giving Beck a slim chance to regain ownership.
Mr. Jackson didn’t give any reason for the withdrawal, but Ms. Beck’s attorney Arshad Majid assumes that since the publication of Beck’s experience she has received tremendous public support and that could be a possible reason for the foreclosure reversal.
Ms. Beck had followed every instruction prescribed to save her home where she has been living since 1989. Confronting a possible foreclosure in September, she got a refinance on her mortgage through Tribeca Lending Corporation and cleared the liability weeks before the due date. Yet her home was auctioned off on September 11, when the deadline to clear the dues was specified as September 27.
Ms. Beck arrived at the Town Hall at 10:00 A.M. on intimation of a possible auction, but her house had been sold by that time. Despite the fact that she paid the mortgage dues weeks before the deadline, unfortunately it was “moments” after Mr. Jackson had purchased it.
Beck’s carrier M&T Mortgage Corporation, Buffalo spokesperson Jean Hill, insists on their efforts to revert the sale, but guarding her company’s interests and deed says Beck had enough opportunities to stall the sale.
Mr. Majid asserts that Beck has been considerably distressed by the entire episode and may consider prosecuting Mr. Jackson for compensation of legal costs, amounting to over $30,000. She is also anxious of new mortgage expected to be over $200,000 due to unpaid interests.
Her initial mortgage had been for $140,000, on which she defaulted because suffering from an injury, she had been temporarily unable to work. Since then she has rejoined at the Daleview Care Center, Farmingdale.
Details of the events prior to September 11 auction - In June, courts gave order to M&T Mortgage Corp. to foreclose Janet Beck’s property for defaulting on mortgage. Date set as August 14. On August 10 Beck’s refinance approved through Tribeca Lending Corp. who intimate M&T. On August 24, M&T send Lendserv Title Company details of Beck’s liabilities. The letter mentions the rescheduled auction date as September 11. On September 4, Beck closes deal with Tribeca Lending Corp. and notifies M&T. On September 10 Lendserv forwards Beck’s due amount to M&T, which is received there at 9:40 A.M. on September 11. Alfred Jackson has already purchased the house (for $217,000) around 9:00 A.M.
