Auctioning of Foreclosed Homes in Maryland Could be Delayed

In Maryland, the courts or the trustees might just delay the process of auction of foreclosed homes if Martin O’Malley the governor including the state legislators and banking regulators can work out another law. This law is intended to help the lenders and the homeowners to meet up and formulate such a scheme for repayment of the mortgages that would not let the situation of foreclosure occur at the first place.

Governor O’Malley has specialized in many such means of prevention and mitigation of the process of foreclosures within the last 2 years. The measures comprise of extension of time of foreclosure by at least 150 days, taking steps against mortgage frauds and preventing the operation of mortgage rescue plans that are fraudulent in nature. However, the number of postings for foreclosures has continued to rise throughout the state.

Alexander Sanchez, the Labor, Licensing and Regulation Department head of Maryland observed that, solving the issues related to foreclosures seems to be quite tough. According to him, the reasons behind the initial flood of foreclosures seemed to be subprime loans and deadly mortgages. Presently a graver scenario like unemployment has superseded these reasons. This is something that is comparatively tough to deal with and finding easy result to this problem is tough.

In the month of November, at least one foreclosure filing was made out of every 364 houses in Maryland. Housing units numbering to almost 6,400 went in for the process of foreclosure while at least 3,317 were prepared for auctioning and there were 711 such housing units that were bank repossessed. Secretary Sanchez feels that, these meetings for mediations might just help to lead to some settlement in the proceedings of the courts. He further added that the bankers and housing advocates including the representatives of the community will come together to work out a proper legislation.

Presently the lenders in Maryland are supposed to inform their borrowers or homeowners at least 90 days before they intend to put that property for foreclosure sale. Moreover, if the borrowers default with their payments then the lender must inform the borrower at least 45 days before they issue any notice to start the process of foreclosure. Even before selling the properties after foreclosures, the lender has to wait for 45 days again.

However, Dave Pulford, the former head of the Maryland Mortgage Bankers Association, feels that these interventions will only add to the costs of foreclosures. He observed that despite making loan modifications most borrowers did not even bother to pay their first installments after modification. The chief executive of Howard Bank, Mary Ann Scully further observed that most borrowers do not even present the proper financial documents. However, Shaun Adamec of the DLLR counters this view as he feels that the lenders have not done enough to help the borrowers in saving their homes from foreclosures.
